TERMS & CONDITIONS OF USE OF EMCARE MOBILE APPS
By registering and/or using the EMCare mobile app, you as a user have agreed and have read, understood and accepted these terms and conditions and the attached privacy policy. These Terms and Conditions and the attached Privacy Policy constitute an agreement regarding the procedures and conditions for using EMCare Mobile Apps between you and us, namely PT. Sarana Meditama Metropolitan Tbk and its subsidiaries.
You agree and acknowledge that We have the right and authority to update these Terms and Conditions from time to time and We will notify you of these updates when you access the Mobile Apps. In the event that you cannot agree to these Terms and Conditions and Privacy Policy, you can stop using the Mobile Apps and delete your account if you have registered as a Mobile Apps user.
I. General Provisions
- An internet connection is required to be able to use Mobile Apps. All costs arising from connecting your electronic device to the internet network are your sole responsibility.
- This Mobile Apps functions to provide information regarding us or the hospitals and/or medical clinics that we manage ("EMC Healthcare") and obtain our services (as defined below) at EMC Healthcare.
- The types of services at EMC Healthcare that can be used via Mobile Apps are:
a. Information Services
Displays information related to EMC Healthcare including but not limited to EMC Healthcare locations, treatment room costs, doctor's practice schedules at EMC Healthcare, health examination offers and other information. Information will be updated by us from time to time.
b. Appointment Services
You can make an appointment with a doctor at EMC Healthcare and you can also reschedule or cancel the appointment.
c. Health Articles and Tips Service
You can access articles and health information on this service which we will update from time to time.
d. Other Services
You will get other additional services that are currently being developed by us.

The Patient Portal service is available to you by activating this service according to the information provided. You can see blab la blah (adjust to the features that will be displayed on the patient portal)
- To avoid doubt, you understand and acknowledge that the information displayed on the Information Services may differ from actual conditions and at our discretion, appointment appointments via the Appointment Service can be changed or canceled at any time by us.
- You understand the appointment schedule under the Appointment Service may change in the event that a doctor is not available.
- You understand that if you need an emergency medical condition, we do not recommend that you use this Mobile Apps.
- You understand that in the event that you wish to carry out a transaction refund process for canceling the Service that you previously registered for on the Mobile Apps, you are required to do so directly at EMC Healthcare depending on the Service location that you have chosen.
- We reserve the right at any time to change, delete, and/or apply new terms and conditions in these Terms and Conditions. Changes to the Terms and Conditions will be effective immediately and will be notified to you when you access the Mobile Apps for the first time after the changes become effective. Your continued use of the Mobile Apps will be deemed as agreement to abide by the changes to the terms and conditions of these Terms and Conditions.
- We reserve the right at any time to change, delete, reduce, add and/or update features or facilities in Mobile Apps. Your continued use of the Mobile Apps will be deemed as agreement to changes, deletions, reductions, additions and/or updates to Mobile Apps features or facilities.

II. Terms of Use for Mobile Apps
- You represent and guarantee that you are an individual who has the right to enter into binding agreements based on the laws of the Republic of Indonesia and that you are at least 21 (twenty one) years old or married, in good health and mental condition and are not under guardianship. or forgiveness. We reserve the right to close or cancel your account if this is not true. You further represent and warrant that you have the right, authority and capacity to use the Mobile Apps and will at all times comply with these Terms and Conditions. If you register on behalf of a business entity, you also declare that you are authorized to act for and on behalf of that legal entity and to enter into and bind that legal entity/entity to the Terms and Conditions and Privacy Policy of the Mobile Apps.
- Your registration for Services on Mobile Apps accompanied by providing your Personal Data information will automatically also be used as account registration on Mobile Apps. Information related to Personal Data provided will only be used by Us for the purpose of providing Services in Mobile Apps, email for login accounts and for other purposes that you have agreed to in accordance with applicable statutory provisions and the Privacy Policy. You must provide true, accurate and complete information, update the information and agree to provide us with any proof of identity that we may reasonably request. If there are changes to the Personal Data that you provide to us, for example, if you change your email address, telephone number, you are obliged to update your information details by sending us your request.
- After registering on the Mobile Apps to get the Service, you will get a personal account that can be accessed with a One Time Password (OTP) , specifically for the Patient Portal Service, you can access the Patient Portal Service using the password you created previously. You promise not to hand over, transfer or authorize anyone else to use your identity or use your account. You are obliged to maintain the confidentiality of the OTP you receive and/or the Patient Portal Service password and any identification we provide to you for your account or Personal Data. In the event that there is a disclosure of the OTP and/or password on the Patient Portal service and/or your account which occurs through no fault of Ours, in any way which results in unauthorized and unauthorized use of your account or You, then You release Us from any consequences or responsibilities that may arise from unauthorized and unauthorized use of your account or you.
- You are required to report to us if you, for any reason, do not have control over your account. You are responsible for every use of your account in Mobile Apps even if the Account has been misused by someone else.
- You may not harm, abuse, change or modify the Mobile Apps in any way. We reserve the right to close or cancel your account and prohibit you from further use of the Mobile Apps if you use the Mobile Apps without complying with these Terms and Conditions.
- You promise that you will use the Mobile Apps only for the intended purpose of obtaining the Services. You are not permitted to misuse or use Mobile Apps for activities that are contrary to the law, including but not limited to criminal acts of money laundering, theft, embezzlement, terrorism or fraud or things that cause inconvenience to other people.
- By providing information (including in this case your specific geographic location as obtained from your hardware's GPS data) to Us, you represent that you have the right to provide us with information that will be used by us either for this Mobile Apps or, with your prior consent. Previously, other health-related applications were being developed by us.
- You acknowledge and agree that any information in any form, including but not limited to video, audio, images or writing contained in the Mobile Apps has its respective intellectual property rights (including but not limited to trademark and copyright rights). You are not permitted to use, modify, facilitate, distribute and/or mutilate the intellectual property rights without permission from the owner of the intellectual property rights as regulated in the applicable laws and regulations.
- When accessing and using Mobile Apps including any features and Services, you are not permitted to:
a. transfer your account on Mobile Apps to another party without our prior approval.
b. spread viruses, spam or other similar technology that can damage and/or harm Mobile Apps and other users.
c. insert or move features in Mobile Apps without our approval.
d. placing information or other applications that violate other parties' intellectual property rights in Mobile Apps
e. harvest or collect Personal Data from other users, including but not limited to email addresses, without the consent of such users.
f. use Mobile Apps for things that are prohibited based on applicable laws and regulations.
g. use Mobile Apps to distribute advertising or other materials. - You understand that all articles regarding health and nutrition that we display are only general in nature and are used solely to educate consumers. Any part of the articles we display cannot be considered and cannot be used as a substitute for medical advice, diagnosis or treatment. - All intellectual property rights contained in Mobile Apps are based on the laws of the Republic of Indonesia, including in this case ownership of intellectual property rights over all Mobile Apps source code and intellectual property rights related to Mobile Apps. For this reason, you are prohibited from violating the intellectual property rights contained in this Mobile Apps, including modifying, derivative works, adapting, duplicating, copying, selling, reproducing, hacking, reselling, and/or exploiting this Mobile Apps including use Mobile Apps for unauthorized access, launching automatic programs or scripts, or any program that may hinder the operation and/or performance of the Mobile Apps, or in any way reproduce or circumvent the navigation structure or presentation of the Mobile Apps or its contents.
- You are only permitted to use the Mobile Apps or copies of the Mobile Apps solely for personal, non-commercial, non-exclusive, non-transferable, non-assignable and non-sublicensable purposes.
- We have the full right to take legal action against any violations committed by you regarding intellectual property rights related to Mobile Apps.
V. Mobile Apps Security and No Guarantees
- We always make reasonable efforts to keep these Mobile Apps functioning and running smoothly. However, we are not responsible and will not be liable for the unavailability of Mobile Apps and/or Service features due to various reasons, including but not limited to maintenance requirements or technical problems. However, you acknowledge and agree that internet transmission or access does not always create a secure and private Mobile Apps, and therefore any message or information that you send or use in the Mobile Apps may be hijacked or taken by irresponsible third parties.

- that this Mobile Apps will be free from errors and/or defects or when operating in combination with other hardware, software, systems or data and that errors and/or defects in the Mobile Apps or Web App will be corrected.
- availability and reliability of Mobile Apps and supporting servers that provide Mobile Apps, including being free from viruses and other dangerous components.
- that the features in the Mobile Apps will match your expectations and needs.
- that the product quality, features and information available will meet your expectations and needs.
VI. Etc
- We have the right to investigate and assert our rights for any violations of these Terms of Use to the extent possible and permitted by law. You hereby acknowledge that We have the right to monitor access to use of the Site and Mobile Apps to ensure compliance with these Terms and Conditions, or to comply with applicable regulations or orders or requirements from courts, administrative agencies or other government bodies.
- We have the right, without prior notification, to take necessary actions if manipulation/fraud is discovered, such as closing or canceling accounts and other things if indications of fraud, money laundering or violations by you of these Terms and Conditions and provisions are found. the laws that apply in the territory of Indonesia.
- These Terms and Conditions apply from the moment you give your consent to use this Mobile Apps and will continue to apply and bind you until we terminate these Terms and Conditions.
- These Terms and Conditions are regulated and interpreted based on the laws of the Republic of Indonesia and in connection with the termination by Us as referred to in paragraph 3 above, you and We agree to waive the provisions of Article 1266 of the Civil Code which requires a court decision in terminating an agreement.
- All disputes that arise between you and us in connection with the implementation of these Terms and Conditions will be resolved by deliberation to reach a consensus. In the event that the dispute cannot be resolved amicably, you and we agree to resolve the dispute through the Tangerang District Court.
